تطبيق أحكام الطلاق الرجعي إنّللطلاقالرّجعيعدّة أحكام تشمل مدّة العدّة، وكيفيّتها، وما يجوزللمرأة فيهذهالفترة. ففي حال طلق الرّجل زوجته طلاقاً رجعيّاً فإنّهيحلّلهالعودة إليها في فترة العدّة بالرّجعة، وذلك دون الحاجة إلىعقدجديد،وفي حال مضت عدّتها يستطيع العودة إليها بعقد جديد فقط. (1)إنّ الطلاق البائن هو الطلاق الذي لا يحقّ للزوج بعده أنيقومبإرجاعمطلقته إلا في حال رضاها، وبعقد جديد، وهو على أقسام:الأوّلأن يقومالرّجل بتطليق زوجته قبل أن يدخل بها وفي حال انتفتالعدّةتنتفيالرّجعة، ومن ذلك أن يوجد سبب تستحق من خلاله الزّوجةالخيار،فتختار أنتتطلق طلاقاً بائناً، ومثال ذلك أن يطلق الرّجلزوجتهالطلقة الثّالثة،ولا تحلّ له في هذه الحالة إلا إذا نكحت زوجاًآخرسواه نكاحاً صحيحاًوتامّاً، يتمّ الوطء فيه (1) .إرجاع المطلقة تحصل رجعة المطلقة بعدّة أمور، منها أنيقولالرّجللزوجته التي طلقها: راجعتك إلى نكاحي، أو ما يقوم مقامهذاالقول منالألفاظ، والتي تدلّ على رجعتها إليه، ومن تلك الأمورأيضاًأن يقومبمجامعتها، أو تقبيلها، أو لمسها بشهوة،كيف يتم الطلاق شرعاً هناك ألفاظ مستعملة يقع بها الطلاق،وهيعلىالنّحو التالي على مذهب جمهور العلماء: (1) . والخلاف فيمسائلالطلاقيرتفع بحكم القاضي، وفي حالة المخطئ الذي يثبت سبق لسانهفإنّالطلاقلا يقع، وإن لم يثبت ذلك قُبل بالفتوى من دون القضاء،وطلاقالملقّنالذي لا يفهم مثل الأعجمي لا يقع، وذلك لعدم قصده بأنيوقعالطلاق،والطلاق الصّريح لا يحتاج إلى نيّة، فهو يقع سواءًأنواهالزّوج أم لمينوه، ولا يقع الطلاق الصّريح في حال لم يعيّنالمتلفظ بهزوجته. وإنّالطلاق في القضاء يقع بكلّ لفظ يدلّ عليه، أمّاديانة فيمابينالإنسان وربّه، فيجب ان ينويه حتى يقع الطلاق به، حتّىوإنكانصريحاً، إلا في حال نواه، لأنّ الأعمال بالنيّات، ولكن فيحكمالقاضيبوقوع الطلاق فإنّه يقع ديانةً وقضاءً في هذه الحالة.ويعتبرلفظاًصريحاً في الطلاق كلّ لفظ لا يتمّ استخدامه إلا عند حلّعقدةالنّكاح،وذلك في عرف كلّ من نطق به، وسمعه، ومن وجّه إليه، وذلكأيضاًبناءًعلى الوضع اللغوي للفظ، أو عرف النّاس في استخدام هذا اللفظفيحالاتالطلاق. وأمّا حكم التلفظ باللفظ الصّريح في حالة الطلاقفهوأنّالطلاق يثبت ويقع به، وذلك مادام أنّ من نطق به يعرفدلالته،وليسشرطاً أن ينوي الطلاق به، وذلك لأنّ اللفظ يكون في هذهالحالةصريحاًفي الدّلالة، وهذا بإجماع العلماء والفقهاء. شروط وقوعالطلاقهناكشرطان أساسيّان لوقوع الطلاق، وهما: (1)مشروعية الطلاق شرع الإسلام الطلاق بسبب أغراض اجتماعيّةضروريّة،ومثالذلك أن يكون هناك شقاق أو نزاع بين الزّوجين، وتقطعتبينهماالعلاقةالزّوجية، وحلّ محلها النّفور والكراهيّة، ولم يكونهناك أيّمجاللإصلاحها، فالحلّ في مثل هذه الحالة هو الطلاق، لأنّالحياةالزّوجيةتنقلب إلى عكس الغرض المطلوب منها في هذه الحالة،وغرضهاالأساسيّ هوإيجاد الألفة والمحبّة والرّحمة بين الزّوجين. قالسيدسابق في كتاب فقهالسنّة: (قال ابن سينا في كتاب الشفاء: ينبغيأنيكون إلى الفرقة سبيلما، وألا يسدّ ذلك من كلّ وجه، لأنّ حسمأسبابالتّوصل إلى الفرقةبالكلية يقتضي وجوهاً من الضّرر والخلل،منها: أنّمن الطبائع ما لايألف بعض الطبائع، فكلما اجتهد في الجمعبينهما زادالشرّ، والنّبؤ (أيالخلاف) وتنغصّت المعايش. ومنها: أنّالنّاس منيمنى (أي يصاب) بزوج غيركفء، ولا حسن المذاهب في العشرة، أوبغيضتعافه الطبيعة، فيصير ذلكداعيةً إلى الرّغبة في غيره، إذالشّهوةطبيعية، ربما أدّى ذلك إلى وجوهمن الفساد، وربما كانالمتزاوجان لايتعاونان على النّسل، فإذا بدّلبزوجين آخرين تعاونافيه، فيجب أنيكون إلى المفارقة سبيل، ولكنّه يجبأن يكون مشدّداًفيه). وقال سيّدقطب رحمه الله في الظلال: (والإسلام لايسرع إلى رباطالزوجيةالمقدّسة فيفصمه لأوّل وهلة، ولأوّل بادرة منخلاف. إنّه يشدّعلى هذاالرّباط بقوّة، فلا يدعه يفلت إلا بعد المحاولةواليأس، إنّهيهتفبالرّجال: (وَعَاشِرُوهُنَّ بِالْمَعْرُوفِفَإِنْكَرِهْتُمُوهُنَّفَعَسَى أَنْ تَكْرَهُوا شَيْئاً وَيَجْعَلَاللَّهُفِيهِ خَيْراًكَثِيراً...)، فيميل بهم إلى التريّث والمصابرةحتّى فيحالةالكراهية، ويفتح لهم تلك النافذة المجهولة: (فَعَسَىأَنْتَكْرَهُواشَيْئاً وَيَجْعَلَ اللَّهُ فِيهِ خَيْراًكَثِيراً...)،فما يدريهمأنّ في هؤلاء النّسوة المكروهات خيراً، وأنّالله يدّخر لهمهذاالخير. فلا يجوز أن يفلتوه. إن لم يكن ينبغي لهم أنيستمسكوابهويعزّوه ! وليس أبلغ من هذا في استحياء الانعطافالوجدانيواستثارته،وترويض الكره وإطفاء شرته). فخرجُوا بعد أن أظهر موسى المعجزات أظهرفيهمالمعجزات،خرجوا من أرض مصر فجاوز موسى بهمُ البحر،البحرُ انفلق له اثني عشر فرقاً كل فرقٍ كالجبلِ العظيم،جعل الله لهم الأرض التي بين هذه الأمواج التي قامتبقدُرةاللهكالجبال،كل واحدةٍ منفصلة عن الأخرى،جعل الله لهم يبَسًا فجاوز بهم موسى فنجوْا من فرعون،وهمكانواستمائة ألف،وفرعون أراد أن يلحقهم بجيشه الجرار، كان جيشهُمليونوستمائةألف،ليبيدوهم على زعمهم،فجاء فرعون ليدركُهم فوجد البحر على هذه الحال التي صارإليهامعجزةلموسى،ثم هلك،أمر الله البحر بأن يلتطم عليهم فهلكوا فرعون وجماعتُهُ،ثم بعد ذلك توجه بهؤلاءالذين معهُ نحو بر الشام دخل بهم أراضي الأردن ثم أمر هؤلاءالذين معه بأن يتوجهوا إلى بيت المقدس ليقاتلوا الجبارينالكفارالذين كانوا مسيطرين على بيت المقدس فلم يطيعوُهمع أنهم رأوا هذه المعجزة الكبيرة، عصوهُ ما أطاعوهُ بالمرة،ثم توفاهُ الله،وتوفي هارونُ قبلهُ ثم أيضا في هذه الحادثة أي حادثةوفاةأخيههارون،أخوه هارون كان صعد هو وإياه إلى جبل فقبضهُ الله تعالىفيذلكالجبل(أي هارون)فلما نزل موسى قالوا له أنت قتلت أخاكلأنه كان أرأف بنا منك هو كان أرحم بنا منك فقتلتهُ(افتروا عليه)ما كلهم افتروا عليه لكن بعضهم فأظهر الله تعالى هارونوهوميتحملتهُالملائكة ومروا به أمام هؤلاء الذينافتروا على موسى بأنه هو قتلهُ فلما رأوا ذلك سكتوُا ثمردتهُ الملائكة ُإلى حيث أمروا،أبوا هؤلاء أن يقاتلوا معهُ فتوفى الله تعالى موسى قبل بيتالمقدس قبل الأرض المقدسة بمسافةٍ قصيرةٍ فهذا دليلٌ أنموسىأمرقومه بالجهادفلو أطاعُوه كانوا قاتلوا أولئك الجبابرةلكن النبي الذي جاء بعده وهو يوشعُ عليه السلام، هذاكانخادمهُ،فتاهُ الذي سافر معه للقاء الخضرِ هذا بعدما توفي موسىأنزلاللهعليه الوحي فجعلهُ نبياً هذا توجهومن معهُ من المؤمنين إلى بيت المقدس فقاتل أولئك قصص الانبياء : قصة إبراهيم عليه السلامقصّة سيّدنا إبراهيم مع قومه وقال أهل السيرة: آزر هو اسمٌ كانيناديبهإبراهيم أباه، بمعنى يا شيخ أو يا مخرِّف؛ حيث ذكر القرآنالكريمقصّةسيدنا إبراهيم عليه السلام مع قومه عندما دعاهم إلى عبادةالله،وتركعبادة الأصنام لكنّهم رفضوا دعوته متمسّكين بدين آبائهمظنّاًمنهمأنّها تقضي حوائجهم، فانتهز إبراهيم عليه السلام في أحدالأيّامالفرصةعندما كان قومه يحتفلون بالعيد، فذهب إلى المعبد وقامبكسرجميع الأصنامباستثناء أكبرهم، ووضع الفأس في رقبته، فعندما عادالقومذهبوا إلىالمعبد ووجدوا الأصنام محطّمةً عدا الصّنم الأكبر،فجاؤوابسيّدناإبراهيم فسألوه هل أنت من حطّم الأصنام؟ فقال لهم:اسألواالصنم فقالواله هو لا ينطق ولا يسمع، فكيف تأمرنا بسؤاله؟!!فعرفوابعدها بأنّه هومن قام بتكسير الأصنام، فأرادوا أن ينتقموا منهعنطريق حرقه في النار،ولكنّ الله جعل النّار برداً وسلاماً علىسيّدناإبراهيم؛ حيث ظلّتالنار مشتعلةً عدّة أيّام دون أن يحترق منهشيء سوىالقيود التي قيّدوهفيها، وحين انطفأت النار خرج سيدنا إبراهيمسالماًلم يمسّه شيء. قصّةسيّدنا إبراهيم مع النّمرود عندما انتشرتقصّةسيّدنا إبراهيم مع قومهوتحدّث النّاس عنها، أراد الملك النّمرودأنيجادل إبراهيم في دعوته:فسأله الملك: من ربّك؟ فقال إبراهيممجيبًا:{ربّي الذي يحيي ويميت}فقال الملك: {أنا أحيي وأميت} حينهاأمر الملكجنوده بإحضار رجلين منالمساجين، فأمر بقتل أحدهما وتركالآخر، ثمّنظر إلى إبراهيم وقال له:ها أنا ذا أحيي وأميت، قتلترجلاً، وتركتآخراً!! فقال له إبراهيم عليهالسلام: {فإنّ الله يأتيبالشمس منالمشرق فأتِ بها من المغرب} فسكتالنّمرود واعترف بعجزه أمامسيّدناإبراهيم عليه السلام. هجرة سيّدناإبراهيم قرّر إبراهيم عليهالسلامالهجرة مع زوجته سارة وابن أخيه لوطالّذيْن لم يؤمن أحدٌسواهما منالمدينة، فذهب إلى فلسطين بالقرب منقرية أربع والتي نشأتفيها مدينةالخليل المحتوية على الحرم الإبراهيمي،ويُعتقد بأنّه دفنفيها بعدذلك. ثمّ هاجر الى مصر بسبب القحط فيفلسطين، وتزوّج هناكهاجر، وأنجبمنها إسماعيل وهو بالسادسة والثمانينمن العمر، أمّا سارةفأنجب منهاإسحاق، وكلاهما من الأنبياء. قصّةسيّدنا إبراهيم مع ابنهإسماعيلعندما أصبح إسماعيل شاباً رأى سيّدناإبراهيم في منامه أنّهيذبحابنه، وبما أنّ رؤيا الأنبياء حقٌّ امتثلإلى أمر الله تعالى وذهبالىابنه اسماعيل وعرض عليه الرؤيا فقال لهإسماعيل: "قال يا أبت افعلماتؤمر ستجدني إن شاء الله من الصابرين"،وعندما جاء ليمتثل إلىأمرالله ، وأراد أن يذبح ابنه، قام بوضع ابنهعلى الأرض حتّى التصقجبينإسماعيل بها، وهمّ بذبحه ولكنّ السكين لمتقطع وتنحر سيّدناإسماعيل،وحينها جاء فرج من الله، بنزول الملك جبريلبكبش فداءلإسماعيل، قالتعالى: {وفديناه بذبح عظيم}، فجاءت سنّة الذبحوالنّحرالّتي أصبحتسنّة للمسلمين كافّة، يؤدّونها في الحج عند البيتالحراموكذلك بقيّةالمسلمين في أيّام عيد الاضحى.كان رجلٌ اسمُهُ آزر، منجماً لملك جبَّارٍ يُسمَّى (نمرود)وكان(نمرود)كافراً باللهِ تعالى.فقال آزر للملك يوماً: إني أرى في حسابٍ للنجوم: أنّهُسينشأُرجلٌينسخُ دينَكَ أيُّها الملكُ، ويدعو إلى دينٍ جديد‍فسأل الملك آزر: وهل وُلِدَ هذا المولود؟قالَ آزر: لا..قالَ الملك: ينبغي أن يفرّق بين الرجالِ والنساءِ، حتى لايحصلَتزاوج،ليكونَ بينهما نسلٌ.ثمّ أمَرَ الملكُ بمفارقة الرجالِ للنساء، ولكن شاء اللهُ أنتحملأمُّ(إبراهيم) بهذا المولود. فحملت.. وأخفَتْ حملها عن الناس، حتىعنأبيه.فلمّا أخذ أمّ (إبراهيم) الطلق، ذهبتْ إلى مكانٍمستترٍووضعتْبإبراهيم، خوفاً على ولدها، ثم قمطته، ورجعت إلى دارها.وكانتالأمّتختلف إلى ولدها وكان ينمو إبراهيم نمواً سريعاً حتىبلغَمبلغَالفتيان.واشتدّ حكمُ نمرود على الأولاد، فكان يقتل كلَّ ولد ذَكر.ولكنشاءَالله أن يبقى إبراهيم في أمنٍ من الملك السفَّاك.خرج ذات يوم إبراهيمُ من مخبئهِ، وعمرُه إذ ذاك ثلاثَ عشرةسنةً.فنظرإلى آثار قدرة الله تعالى في السماوات والأرض، وشاء الله أنيلفتنظرإبراهيم إلى آيات الكون(وكذلك نري إبراهيم ملكوت السماواتِ والأرض وليكونَ منالموقنين)وهكذا،كان ينظرُ إلى آياتِ الله تعالى، حتى قربت الشمسللأفول.(فلما جنّ عليه الليل رأى كوكباً) في السماء وكان الكوكبُ(زهرة)،ورأىإنّ جماعة من الناس يعبدونه، ويخضعون له فتعجّب منفعلهمهذا.و(قال) مستنكراً عبادتهم للكوكب: (هذا ربي)؟ ونظر إليهم في صمت!لكنكانيتحيّن الفرصةَ، للردّ عليهم..فلمّا (أفل) غربَ الكوكبُ..Stories oftheProphets:The Story of AbrahamThe story of Abraham with his people and said thepeopleofBiography: Azar is the name he used to call him Abrahamhisfather,in the sense O Sheikh or O Mkhrv; as mentioned in theHolyQur'anThe Story of Abraham with his people when he invitedthemtoworship God, and leave the worship of idols but theyrefusedtocall cling to religion parents thinking that theyspendtheirbusiness, Vanthz Abraham one day the opportunity when itwashispeople celebrate Eid, he went to the temple and broke alltheidolsexcept the eldest, and put the ax in the neck, whenhereturned themen went to the temple and found the idolssmashedexcept thebiggest idol and brought our master Abraham askedhim,Are yousmashed idols?
