Description

الإفتاء لغةً: أصل الفعل "فتي أو فتو"، والإفتاء مصدر "فتي"تعني"الإبانة، أي إبانة الشيء على حقيقته بالبيان والعلم، ويقالأفتيتفلان أي أجبته عن مسألته التي سأل عنها.

الفتوى إصطلاحاً: الفتوى هي جواب المفتي عن أي سؤال من السائلوكانمتعلّقاً بالحكم الشرعي للسؤال، وتكون الإجابة "إجتهاد" منالمفتيفيما يتعلّق بالسؤال، بالإستناد إلى الأحكام الواردة في القرآنالكريموالسنّة النبويّة الشريفة.

أركان الفتوى:

أركان الإفتاء أربعة؛ وهي: المفتي، والمستفتي، والمستفتىعنه،والمفتى به.

1- المفتي: وهو العالم الشرعي الإسلامي الذي يقوم بإصدارالفتوىوالإجابة عن السؤال.

2- المستفتي: وهو الشخص الطّالب للإجابة والحكم الشرعيّ.

3- المستفتى عنه: وهو السؤال عن الحكم، والمسألة المسؤول عنه،ويجبأن تكون هذه المسألى فيها إلتباس وتحتاج بياناً في الحكم، ويجبأنيكون المستفتى عنه فيه لبس وليس حكماً شرعيّاً واضحاً.

4- المفتى به: وهو الحكم الشرعيّ والجواب عن السؤال، ويكونالجوابمستمدّاً من القرآن الكريم، أو السنّة النبويّة، أوبالإجماع.

4. Mufti him: a legitimate governance and the answer tothequestion, and the answer is derived from the Koran, or theSunnah,or unanimously.
