UNDANG-UNDANG REPUBLIK INDONESIA
NOMOR 11 TAHUN 2012
TENTANG
SISTEM PERADILAN PIDANA ANAK

DENGAN RAHMAT TUHAN YANG MAHA ESA
PRESIDEN REPUBLIK INDONESIA,

Menimbang:

a. bahwa anak merupakan amanah dan karunia Tuhan Yang Maha Esayang memiliki harkat dan martabat sebagai manusia seutuhnya;

b. bahwa untuk menjaga harkat dan martabatnya, anak berhakmendapatkan pelindungan khusus, terutama pelindungan hukum dalamsistem peradilan;

c. bahwa Indonesia sebagai Negara Pihak dalam Konvensi Hak-HakAnak (Convention on the Rights of the Child) yang mengatur prinsippelindungan hukum terhadap anak mempunyai kewajiban untukmemberikan pelindungan khusus terhadap anak yang berhadapan denganhukum;

d. bahwa Undang-Undang Nomor 3 Tahun 1997 tentang PengadilanAnak sudah tidak sesuai lagi dengan perkembangan dan kebutuhanhukum masyarakat karena belum secara komprehensif memberikanpelindungan kepada anak yang berhadapan dengan hukum sehingga perludiganti dengan undang-undang baru;

e. bahwa berdasarkan pertimbangan sebagaimana dimaksud dalamhuruf a, huruf b, huruf c, dan huruf d, perlu membentukUndang-Undang tentang Sistem Peradilan Pidana Anak;

Mengingat:

1. Pasal 5 ayat (1), Pasal 20, Pasal 28B ayat (2), Pasal 28G,dan Pasal 28I Undang-Undang Dasar Negara Republik Indonesia Tahun1945;

2. Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia(Lembaran Negara Republik Indonesia Tahun 1999 Nomor 165, TambahanLembaran Negara Republik Indonesia Nomor 3886);

3. Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak(Lembaran Negara Republik Indonesia Tahun 2002 Nomor 109, TambahanLembaran Negara Republik Indonesia Nomor 4235);

4. Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksidan Korban (Lembaran Negara Republik Indonesia Tahun 2006 Nomor 64,Tambahan Lembaran Negara Republik Indonesia Nomor 4635);

5. Undang-Undang Nomor 16 Tahun 2011 tentang Bantuan Hukum(Lembaran Negara Republik Indonesia Tahun 2011 Nomor 104, TambahanLembaran Negara Republik Indonesia Nomor 5248);

Dengan Persetujuan Bersama
DEWAN PERWAKILAN RAKYAT REPUBLIK INDONESIA dan PRESIDEN REPUBLIKINDONESIA MEMUTUSKAN:

Menetapkan:

UNDANG-UNDANG TENTANG SISTEM PERADILAN PIDANA ANAK

ABOUT
CRIMINAL JUSTICE SYSTEM OF CHILDREN

BY THE GRACE OF GOD ALMIGHTY
PRESIDENT OF THE REPUBLIC OF INDONESIA,

Considering:

a. that the child is a trust and the gift of God Almighty whohas dignity and worth as human beings;

b. that in order to maintain the dignity and status, childrenare entitled to special protection, especially protection of thelaw in the judicial system;

c. that Indonesia as a State Party to the Convention on theRights of the Child (Convention on the Rights of the Child), whichregulates the principles of legal protection of children have anobligation to provide special protection to children in conflictwith the law;

d. that Act No. 3 of 1997 on Juvenile Justice is no longerrelevant to the development and needs of the community as notcomprehensively provide protection to children in conflict with thelaw that needs to be replaced with new legislation;

e. that based on the considerations set forth in paragraphs a,b, c, and d, it is necessary to form the Law on Criminal JusticeSystem Child;

Given:

1. Article 5 paragraph (1), Article 20, Article 28B paragraph(2), Article 28G, and Article 28 of the Constitution of theRepublic of Indonesia Year 1945;

2. Law No. 39 of 1999 on Human Rights (State Gazette of theRepublic of Indonesia Year 1999 Number 165, Supplement to StateGazette of the Republic of Indonesia Number 3886);

3. Act No. 23 of 2002 on Child Protection (State Gazette of theRepublic of Indonesia Year 2002 Number 109, Supplement to StateGazette of the Republic of Indonesia Number 4235);

4. Act No. 13 of 2006 on Witness and Victim Protection (StateGazette of the Republic of Indonesia Year 2006 Number 64,Supplement to State Gazette of the Republic of Indonesia Number4635);

5. Law No. 16 of 2011 on Legal Aid (State Gazette of theRepublic of Indonesia Year 2011 Number 104, Supplement to StateGazette of the Republic of Indonesia Number 5248);
